1. Agreement

1.1 This agreement becomes effective once all bookings have been confirmed in writing by the relevant operators, the client has confirmed their safari in writing, and a 25% non-refundable deposit has been received by Okutembuka Safaris.
1.2 This agreement is governed by the laws of Namibia. Any legal proceedings shall be conducted in Windhoek, Namibia.
1.3 Any person or persons making a reservation with Okutembuka Safaris represents that they have the authority to enter into this agreement on behalf of themselves and/or any other parties included in the booking and shall be liable for the total amount due.
1.4 By paying the deposit, the client confirms acceptance of these Terms and Conditions.

2. Booking and Reservation

2.1 A 25% non-refundable deposit of the total booking cost is required to secure any reservation.
2.2 The balance of payment must be received by Okutembuka Safaris no later than forty-five (45) days prior to the scheduled arrival date.
2.3 Should the outstanding balance not be received by Okutembuka Safaris within forty-five (45) days prior to arrival, Okutembuka Safaris reserves the right to cancel the reservation and retain any deposits or payments already received.
2.4 Accommodation and services will be provided as listed in the confirmed final itinerary and pricing summary, subject to availability. Okutembuka Safaris reserves the right to substitute accommodation of equal or higher standard should the listed options be unavailable.

3. Payment Procedure

3.1 A 25% non-refundable deposit is required upon confirmation of the reservation.
3.2 All payments must be made by direct deposit or electronic bank transfer into the Okutembuka Safaris designated bank account. Banking details will be provided upon confirmation of the booking.
3.3 All bank charges and transfer fees are the responsibility of the client.

4. Cancellation Policy

4.1 All cancellations must be submitted in writing (email or letter) and acknowledged in writing by Okutembuka Safaris.
4.2 The following cancellation fees apply:
• 25% of the total amount if cancelled after safari confirmation.
• 50% of the total amount if cancelled 90 days before the departure date.
• 75% of the total amount if cancelled within 45 days of departure.
• 100% of the total amount if cancelled 30 days prior to arrival or in case of a no-show.
4.3 In the event of a cancellation, Okutembuka Safaris will make reasonable efforts to negotiate a travel credit for the client, valid for 12 months from the original booking date. Should the client choose to cancel rather than postpone, the deposit / balance payment will be forfeited in full.
4.4 In the event of a client cancelling their participation in a group booking, the remaining participants may be liable for any resulting increase in the per-person tour price.
4.5 No refunds are given for no-shows, unused services, or once the tour has commenced.
4.6 Okutembuka Safaris reserves the right to cancel or terminate a client’s participation without refund in cases of illness, illegal activity, or conduct deemed incompatible with the interests and wellbeing of the group.

5. Breakaways

5.1 Should a client decide to deviate from the planned tour itinerary after commencement, all resulting expenses will be for the client’s account. No refunds will be given for any unused services.

6. Price Changes

6.1 Okutembuka Safaris reserves the right to adjust the contract price before departure due to factors beyond its control, including but not limited to increases in airport taxes, exchange rate fluctuations, VAT changes, fuel price increases, or new government levies.
6.2 Please note that all charges in Botswana are in USD. The exchange rate applicable on the day of payment will be used. If there is a difference between the exchange rate at the time of deposit and the time of final payment, the outstanding balance will be adjusted accordingly based on the USD exchange rate on the payment date.

7. Itinerary Alterations

7.1 While every effort will be made to adhere to the confirmed itinerary, Okutembuka Safaris reserves the right to make reasonable changes where necessary in the interests of client safety or operational requirements.

8. Force Majeure

8.1 Okutembuka Safaris shall not be held liable for any delay, loss, damage, or cancellation due to acts of God, government restrictions, natural disasters, pandemics, civil unrest, or any other causes beyond its reasonable control.

9. Liability Disclaimer

9.1 Participation in any safari tour arranged by Okutembuka Safaris is undertaken at the client’s own risk. Okutembuka Safaris accepts no liability for any loss, injury, illness, or death arising from services provided, except where such liability is imposed by Namibian law.
9.2 Clients are strongly advised to obtain comprehensive travel insurance covering cancellation, curtailment, personal accident, medical expenses, loss of luggage, and personal liability.

10. Travel Insurance

10.1 It is a condition of booking that all clients must have appropriate Visa and travel insurance in place before departure, and proof of such insurance may be requested.
